TalorData Website Terms of Service
This Agreement is a contract between you and the operator of the TalorData website (www.talordata.com, hereinafter referred to as the "Website"). Please read these Terms of Service carefully. By clicking "Agree", completing registration, purchasing services, or using TalorData services in any way, this Agreement constitutes a legally binding document between both parties.
TalorData provides users with the products and services displayed on this Website (hereinafter referred to as "TalorData Services" or "the Services"), including but not limited to SERP API, search data services, and proxy network services. TalorData reserves the right to update, adjust, or change the service content based on business development needs, and the specific services provided on this Website shall prevail.
TalorData provides technology and data access services and assumes no responsibility for your specific business activities, data usage, or compliance with third-party platform policies.
1. General Terms
You acknowledge that before using the Services, you have fully read, understood, and accepted all the terms of this Agreement. Once you complete registration, log in, purchase, call the API, or actually use the Services, you agree to comply with this Agreement and related rules.
TalorData reserves the right to modify this Agreement and service rules at any time based on business development, laws and regulations, operational strategies, or risk control needs, and will announce such modifications through website announcements, in-site notifications, or other reasonable means without separate notice to you.
If you continue to use the Services after the Agreement is updated, you will be deemed to have accepted the modified Agreement; if you do not agree to the modified Agreement, you must immediately stop using the Services.
2. Account
2.1 Registration
You acknowledge that when you complete the registration process, purchase services, call the API, or actually use the Services in other ways permitted by TalorData, you must be a natural person, legal entity, or other legitimate organization with full capacity for civil rights and civil conduct (collectively referred to as "Legitimate Entity").
If you are using the Services on behalf of a business, organization, or other entity, you represent and warrant that you have obtained full authorization to accept and comply with this Agreement on behalf of that entity.
If you are a minor or a person with limited capacity, you do not have the above qualifications. All consequences arising from your improper registration or use of the Services shall be borne by you and your legal guardian. TalorData has the right to restrict, suspend, permanently freeze, or terminate your account and reserves the right to pursue relevant liabilities.
2.2 Account and Real-Name Authentication
After you fill in the information as prompted on the registration page, read and agree to this Agreement, and complete the entire registration or activation process, you will be bound by this Agreement.
You may use the email address, mobile phone number, or other methods permitted by TalorData that you provide or confirm as your login credentials.
You understand and agree that after completing the registration process, you will obtain a TalorData account. TalorData permits one Legitimate Entity to have multiple TalorData accounts, but each account can only correspond to one Legitimate Entity.
Except as required by laws and regulations, valid legal documents, or expressly permitted by TalorData, you may not transfer, sell, rent, give, lend, or allow others to use your TalorData account in any way.
To ensure account security, transaction security, risk control, and compliance requirements, TalorData has the right to request you to undergo real-name authentication, identity verification, or provide relevant supporting materials at any time, including but not limited to:
- Identity proof;
- Business information;
- Payment information;
- Contact information;
- Tax or compliance documents.
Only after completing the relevant verification will you be eligible to continue using some or all of the Services.
You shall ensure that the information you provide is true, accurate, complete, and continuously valid, and promptly update your email address, phone number, and other contact information.
If TalorData cannot contact you due to invalid, inaccurate, incomplete, or untimely updated information you provide, or if any loss, risk, liability, or additional cost arises therefrom, you shall bear it all by yourself.
TalorData has the right to review, verify, restrict, or freeze your account based on risk control, security audits, anti-fraud, anti-abuse, compliance investigations, or legal and regulatory requirements.
2.3 Account Security
You shall properly keep your TalorData account, password, API Key, access tokens, and other authentication information, and are responsible for all activities and actions conducted through your account, including but not limited to:
- API requests;
- Service calls;
- Information publishing;
- Data access;
- Online payments;
- Agreement confirmations;
- Package purchases;
- Account operations.
Except as otherwise provided by laws and regulations or with TalorData's written consent, your account and related access credentials shall not be transferred, shared, sold, rented, or authorized to any third party in any form.
You shall not:
- Share your API Key or account with any third party;
- Use multiple accounts to circumvent risk control, billing, or call limits;
- Affect system stability through abnormal requests;
- Access other users' accounts or system resources without authorization;
- Bypass TalorData's security mechanisms, access restrictions, or verification rules.
If you discover any anomalies, unauthorized access, security vulnerabilities, or credential leaks related to your account, you shall immediately notify TalorData.
You understand and agree that TalorData has the right to understand the true background and purpose of your use of the Services and to request you to provide true, comprehensive, and accurate information. If TalorData has reasonable grounds to suspect that:
- The information you provide is untrue;
- You are engaging in fraudulent transactions;
- You are generating abnormal traffic or engaging in high-risk behavior;
- You are violating this Agreement or related rules.
TalorData has the right to take measures to restrict, suspend, ban, or terminate your account and related services without prior notice.
To the extent permitted by laws and regulations, TalorData has the right to query, monitor, restrict, or freeze relevant accounts, data, or transactions based on legitimate requests from judicial authorities, administrative authorities, regulatory agencies, or security departments.
2.4 Account Cancellation and Termination
TalorData has the right to suspend, restrict, or terminate some or all of the Services under the following circumstances:
- You violate this Agreement;
- You are suspected of illegal or non-compliant activities;
- You engage in fraud, abuse, or abnormal behavior;
- You refuse to cooperate with real-name authentication or compliance reviews;
- You pose high-risk traffic or security risks;
- Your actions may affect system stability or the rights of third parties;
- Laws, regulations, or regulatory requirements necessitate such measures.
If you have not logged into this Website using your email address, mobile phone number, or other methods recognized by TalorData for 12 consecutive months, and there are no active services or outstanding orders under your account, TalorData has the right to cancel or revoke your account login permissions.
After account termination, TalorData has the right to stop providing related Services and to delete relevant data without incurring any liability.
3. Terms of Use for Website Services
3.1 Instruction Confirmation
Operational instructions issued through the following methods will be deemed as your own actions, and you shall bear corresponding responsibility:
- Actions taken using your account and password;
- Requests made using your API Key;
- Actions taken using your bound phone number, email, or other verification methods;
- Other methods recognized by TalorData.
3.2 Service Rules
When using the Services, you shall comply with this Agreement, page descriptions, API documentation, product rules, and relevant notices published by TalorData.
TalorData has the right to adjust service rules, call limits, package rules, and product functions based on business needs.
3.3 Service Notifications
TalorData may send service notifications, risk alerts, or system announcements to you via email, SMS, in-site notifications, or other methods.
TalorData does not guarantee that you will receive such notifications in a timely manner; therefore, you should promptly monitor your account status and system information.
3.4 Identity Verification Authorization
You authorize TalorData and its partners to verify your identity and related information as needed for compliance, risk control, security audits, and other purposes.
3.5 Service Fees
TalorData has the right to charge you relevant service fees based on product pages, orders, package rules, or bilateral agreements.
TalorData has the right to adjust pricing, resource limits, package content, and billing methods based on business development needs.
Except as otherwise provided by laws and regulations, paid fees are generally non-refundable.
For accounts with violations, abuse, fraud, abnormal traffic, or high-risk behavior, TalorData has the right to refuse refunds.
3.6 Third-Party Services
If you use third-party products, websites, or services while using TalorData Services, you shall also comply with the relevant agreements and rules of such third parties.
TalorData assumes no responsibility for the availability, legality, stability, or security of third-party services.
3.7 Prohibition of Fraud and Abuse
You shall not use TalorData Services to engage in any illegal, fraudulent, misleading, or rights-infringing activities, including but not limited to:
- Mobile ad fraud;
- Click fraud;
- Install fraud;
- Affiliate fraud;
- Generating fake traffic or bot traffic;
- Ad attribution cheating;
- Using automated programs to fake user behavior;
- Any conduct that violates the policies of advertising platforms, app stores, affiliate platforms, or third-party services.
You shall not use TalorData Services to commit, assist, promote, or participate in the above activities.
Upon detection, TalorData has the right to immediately suspend or permanently terminate the relevant accounts and Services without prior notice, and reserves the right to pursue legal liability and claim damages.
3.8 Search and Data Usage Restrictions
You shall not use TalorData Services to engage in any conduct that violates laws and regulations, search engine rules, or third-party platform policies, including but not limited to:
- Large-scale malicious search requests;
- SEO manipulation, ranking cheating, or interference with search results;
- Automated spam generation or distribution;
- Unauthorized large-scale data scraping;
- Bypassing access restrictions, CAPTCHAs, or security mechanisms;
- Interfering with, attacking, or affecting the stability of third-party websites, platforms, or services;
- Violating the terms of service of Google, Bing, Yahoo, DuckDuckGo, or other search engines;
- Abusing search engine resources;
- Illegal monitoring, privacy infringement, or data abuse.
TalorData has the right to restrict, suspend, ban, or terminate services for related accounts based on system security, risk control, third-party complaints, abnormal traffic, violations, or compliance requirements, without prior notice.
If your conduct results in any claims, penalties, losses, liabilities, or expenses (including but not limited to attorney fees, investigation costs, and reasonable enforcement costs) being suffered by TalorData, partners, suppliers, or third parties, you agree to bear full responsibility and compensate for all resulting losses.
3.9 API and Proxy Service Usage Rules
You understand and agree that some of the Services provided by TalorData are API data interfaces and proxy network services, which may be affected by third-party website policies, search engine rules, network environments, regional restrictions, and system risk controls.
You shall not:
- Bypass TalorData's request limits, concurrency limits, or billing rules;
- Share, sell, transfer, or abuse API Keys;
- Affect system stability through abnormal requests;
- Maliciously consume system resources through automated means;
- Use TalorData Services to bypass access restrictions or security mechanisms of third-party platforms.
TalorData has the right to limit, delay, reject, or ban requests based on system load, resource consumption, security risks, or abnormal behavior.
TalorData does not guarantee:
- That any target website will always be accessible;
- That any request will always succeed;
- That search results will remain consistent over the long term;
- That any proxy IP will remain stable and available over the long term;
- That third-party platforms will not adjust their risk control or access policies.
3.10 Data and Intellectual Property
TalorData does not own the intellectual property rights in third-party websites, search engines, or platform data.
The intellectual property rights in search results, web content, data, or third-party information obtained through TalorData Services belong to the original rights holders.
You shall ensure that your collection, storage, processing, and use of relevant data comply with applicable laws and regulations and third-party platform policies.
Without authorization from the relevant rights holders, you shall not use data obtained through TalorData Services to engage in any conduct that infringes on intellectual property rights, trade secrets, or other legitimate rights and interests.
3.11 Service Availability and Limitation of Liability
TalorData will make reasonable commercial efforts to maintain service stability, but does not guarantee that the Services will always be continuous, uninterrupted, delay-free, error-free, or fully meet user expectations.
You understand and agree that TalorData Services may be affected by various factors, including but not limited to:
- Search engine policy adjustments;
- Third-party website risk controls or restrictions;
- Network fluctuations;
- ISP or carrier issues;
- System upgrades and maintenance;
- Third-party service interruptions;
- Force majeure events;
- Security risks or abnormal traffic controls.
TalorData does not guarantee:
- That any request will always succeed;
- That any target website will remain continuously accessible;
- That search results will remain consistent over the long term;
- That any proxy IP will remain stable and available over the long term;
- That the Services will not be subject to third-party restrictions or interference.
To the maximum extent permitted by applicable law, TalorData shall not be liable for any direct or indirect losses, loss of profits, business interruption, loss of data, or loss of anticipated savings arising from service interruptions, request failures, data inaccuracies, access restrictions, blocks, delays, deletions, or third-party actions.
4. Governing Law and Miscellaneous
The formation, effectiveness, interpretation, and performance of this Agreement shall be governed by the laws applicable to the jurisdiction where the operator of TalorData is located.
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.
TalorData's failure to exercise or delay in exercising any right under this Agreement shall not constitute a waiver of that right.
TalorData has the right to update or modify this Agreement based on business development, laws and regulations, regulatory requirements, or service adjustments. The updated Agreement will be published on this Website and will take effect on the date of publication.
